NOTICE OF PUBLIC HEARING 

OHIO DEPARTMENT OF TRANSPORTATION

Due to COVID-19 precautions, this public meeting will be conducted virtually via Microsoft Teams Meeting.  Anyone wishing to attend and/or testify can join by calling in at the above date and time to 1-614-721-2972.  Then enter the meeting I.D. which is 912 666 314#.  Written testimony may also be submitted electronically to Brianne.Brown@dot.ohio.gov The public hearing will continue until all parties in attendance have an opportunity to be heard.

Pursuant to Ohio Administrative Code 5501-2-05 and Ohio Revised Code Section 119.03, notice is hereby given that the Ohio Department of Transportation intends to consider the amendment of the rules identified below and of a public hearing thereon.

Rule 5501:2-6-01, entitled Definitions, is being proposed for amendment to update the qualifications for a business to be able to advertise and to allow the Director more discretion when reviewing these businesses, with the ultimate goal of providing more knowledge and awareness to the traveling public of available businesses providing services..  This rule describes definitions that govern the specific service sign program.  The changes to the rule include adding two new definition sections to the existing rule.  
    
Rule 5501:2-6-03, entitled Interchange eligibility is being proposed for amendment to update the qualifications for a business to be able to advertise and to allow the Director more discretion when reviewing these businesses, with the ultimate goal of providing more knowledge and awareness to the traveling public of available businesses providing services.  This rule describes the requirements for placement of specific service signs in interchanges under the business logo sign program. The change to the rule includes giving flexibility for any reasonable variances as to the location of the sign to be made by the director.

Rule 5501:2-6-04, entitled Business eligibility is being proposed for amendment to update the qualifications for a business to be able to advertise and to allow the Director more discretion when reviewing these businesses, with the ultimate goal of providing more knowledge and awareness to the traveling public of available businesses providing services.  This rule describes eligibility criteria for those business wanting to participate in the business logo sign program.  The changes to the rule include clarifying requirements for a business to qualify for a food logo sign panel and also giving the director flexibility to determine any reasonable variances as to the business eligibility criteria contained in the rule.

A copy of the proposed rules is available, without charge, to any person affected by the rules at the email address listed below. The rules are also available on the internet at: http://www.registerofohio.state.oh.us/.  The Ohio Department of Transportation shall hold a public hearing on the proposed rules at the date, time, and location listed at the top of this notice.  Either oral or written testimony will be taken at the public hearing.  Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
